Strategic Elder Law Planning and Medicaid Lawyers

Medicaid benefits are most commonly used to care for the needs of the elderly and to subsidize the rising costs of nursing home care. To qualify for Medicaid benefits, the beneficiary must be financially and categorically eligible. At The Law Offices of Spano & Dawicki in Boston, Massachusetts, we have extensive experience handling the complex nature of Medicaid law and will work strategically to get the benefits you need.

Medicaid Eligibility Lawyers in Boston

To be eligible for benefits, an individual must require assistance with at least two of the following six daily activities: bathing, dressing, toileting, transferring (moving from bed), eating or caring for incontinence.

In addition to categorical impairments, the individual must qualify financially. To be eligible, a single individual cannot have assets in excess of $2,000 and cannot have a home with equity in excess of $750,000. For married couples, there is no limit on home value and assets cannot exceed $100,000. If you are considering Medicaid benefits, remember that there are ways to organize your finances so that you qualify or to protect benefits for the future. Our attorneys are experienced in Medicaid planning and can help you protect your rights.

Our lawyers can help you prepare Medicaid applications and can represent you in fair hearings to determine Medicaid benefits eligibility. We can also help you with asset protection through Medicaid trusts or other techniques.
